Most of us think that we'll get round to making a will 'in the future' or that 'nothing will happen to me yet'. A recent survey showed that almost everyone makes a wrong assumption over who would benefit if they die without a Will. Most married people assume their spouse automatically inherits everything they own, with or without a Will. This is not true. Most unmarried couples also assume that they have the same legal rights to inherit as a married couple. This is not true either.

Currently, unmarried couples have no guaranteed rights to inherit whatsoever and married couples can only guarantee to inherit everything if there is a Will, depending upon the size of the estate.

It is advisable for clients, particularly in cases where there is trust work to be carried out on first death, that they store their documents with Us. We are then in a position to advise the surviving spouse as to the best way forward and arrange to have put in place whatever trusts are required.
